These terms are between you and UNHYPED PTE. LTD. (UEN 202633592D), a company incorporated in Singapore with its registered office at 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore 068914 (“Unhyped”, “we”, “us”). Contact: [email protected].
They apply to the Unhyped mobile app, our websites unhyped.wine and unhypedwine.com, the merchant storefronts we host on their subdomains, terroirists.com, and our regional sites. Together, “the service”. By using the service you accept these terms. If you do not accept them, do not use the service.
Unhyped describes wine by the ground it grew on, and points you to bottles sold by merchants who use our platform.
A score is our opinion. It is offered for interest and discovery. It is not advice, and it is not a guarantee of the quality, provenance, condition, taste or value of any bottle. Unhyped is still evolving and its scores and descriptions change as it does.
We try hard to be right, and we correct errors. If you think we have a vineyard, a wine or a producer wrong, write to [email protected]. We will check it and fix what we can, usually within ten working days, and we will tell you what we did.
We are not a retailer. Bottles are sold by the merchants named on the page. Any order, payment, delivery, refund or complaint about a bottle is between you and that merchant, on that merchant’s terms. Prices, availability and vintages are supplied by merchants or read from their sites and can be out of date. Check with the merchant before you rely on them.
Descriptions are not health advice. The service concerns alcohol. Drink responsibly.
You may use the service only if you are of legal drinking age where you are, and in any case at least 18. We may ask you to confirm this and may refuse or end access if we believe you are not.
Some features need an account. Keep your password to yourself; you are responsible for what is done through your account. You can delete your account at any time in the app or by emailing us. We handle your personal data as described in our Privacy Policy.
When you scan a label, a list or a shelf you send us a photo. You confirm you are entitled to do so, and you give us a licence to process it to answer you and to improve the service, as the Privacy Policy describes. You keep whatever rights you have in the photo.
The map, the scores, the descriptions, the software, the designs and the names Unhyped, Vintelligence and Terroirists are ours or licensed to us. You may use the service for personal, non-commercial discovery and may share a card or a link the way the product lets you. Everything else needs our written permission.
A storefront at a merchant’s subdomain is that merchant’s shop, run on our platform. The merchant is responsible for its inventory, prices, licences, sales and fulfilment, and for displaying any licence details the law requires. We provide the map, the sommelier and the site. We are not party to the sale.
The service is provided as it is and as available. It is in active development and features change. We may change, suspend or withdraw any part of it. We may update these terms; if a change matters we will say so in the app or on the site, and your continued use after that is acceptance.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Singapore law.
Otherwise, to the fullest extent the law allows: we are not liable for indirect or consequential loss, loss of profit, or loss arising from a bottle bought from a merchant, from reliance on a score or description, or from unavailability of the service; and our total liability to you in any twelve months is limited to the greater of what you paid us in that period and S$100.
Singapore law governs these terms. If a dispute arises, write to us first at [email protected] and we will try to resolve it within 30 days. Failing that, the courts of Singapore have exclusive jurisdiction.
If part of these terms is unenforceable the rest stands. These terms and the Privacy Policy are the whole agreement between us about the service. We may assign them to a successor of the business; you may not assign them. Nothing here gives rights to anyone who is not a party, and the Contracts (Rights of Third Parties) Act 2001 does not apply.
